Buying a property? Before you decide to buy a property, it’s important to conduct due diligence first to protect your investment and ensure a safe property transaction.

Here are the steps for due diligence to ensure safe transactions when purchasing a property.

  1. Request from the seller the photocopy of the title, the tax declaration, and the proof of payment of real property tax.

  2. Determine if the registered owner found in the title is the seller or an attorney-in-fact. If merely an attorney-in-fact, request for a copy of the special power of attorney authorizing them to transact and sell the property.

  3. Request for a Certified True Copy (CTC) of the title through any Registry of Deeds or online via the LRA eSerbisyo Portal (eserbisyo.lra.gov.ph) to check if:

  • The title is existing in the records of the Registry of Deeds

  • The title is clean, meaning there is no annotation of any encumbrances on the title

  • The title presented by the seller is a mirror copy of the original copy, which in this case is the CTC issued by the RD.

  1. Request for a CTC of the tax declaration from the Municipal/City Assessor's Office to verify if the title presented by the seller has a tax declaration.

  2. Request for a Tax Clearance Certification using the official receipt of the payment of Real Property Tax.
